The Divorce Act was signed in 1968, and while it was amended in 2004 to ensure that same-sex couples were included, a lot of the law is probably still what was written 50 years ago. Back then, divorce was still considered rather unsavory, so it was likely a compromise clause put in just to ensure its passage, and perhaps as well to prevent people from coming up here just to have a divorce (No-Fault divorce, at least, didn't begin in the US until the following year, and New York didn't legalize it until last year).

I must be missing something. So, gay couples went to Canada to get married because their homeland didn't legally recognize gay marraige. Now they are looking to be able to divorce in Canada but can't because they need a 12 mo residency.

Uhm, this might seem rude but wtf were they doing getting married in a different country if it wasn't able to be legally recognized in the country they live in (ie: pay taxes, get benefits etc) in the first place? Was it just to say they did it? Is that not akin to just putting on a non legally binding ceremony - since the only legally recognized benefits are in a country they don't even live in?

This all seems very fucking stupid to me - and I'm so pro gay I sneeze rainbows.

I must be missing a bigger part of the story, because it honestly can't be this fucking stupid.

I don't know about the details, but I've heard that some jurisdictions* that don't perform same-sex marriages acknowledge same-sex marriages legally performed elsewhere. That could make sense of it.

*Edited for the word I actually wanted to use.

ETA again: Though it occurs to me that then they really should be seeking the divorce in that jurisdiction. Yeah, I don't know.

Maybe it's the satisfaction of having a document that proves that somebody, somewhere acknowledges your love? It doesn't really make sense to me either, and I'm gay.

I know the US doesn't recognize it; no clue about other countries.

By the way I'm very familiar with that residency divorce law. I couldn't ask for a divorce because despite living in Canada for 2 years I never managed to get residency, and couldn't ask for a divorce in France because even though it only requires you to show up and say "hey, we want a divorce" and sign a piece of paper, you both have to show up in a court house in France at the same time, and he lives in Canada and won't make the trip.
(French law states that only a mayor or depute mayor can legally marry you, only a judge can legally divorce you. Other than that it's really hassle free to do either).

Also, Canada requires a separation of at least a year for a no fault divorce, by the way, which is also a pain. France has no such requirement.

Long story short, I'm still married because my ex is the biggest procrastinator on Earth and he is the only one allowed to apply for a divorce.

We're opposite sex by the way. But I assume the law would be similar for same-sex couples since they changed it to make it the same for both (in Canada I mean. France only has civil unions for same-sex couples, and I don't know much about these because we decided to get married rather than have a civil union).

Anyways, I think the idea of same-sex couples getting married in another country might have been "when it becomes legal here, they'll recognise our marriage from the time it started, and therefore we'll have been married longer". Or maybe it's meant as an activism action. Or being able to say they're legally married, even if it's in another country. I guess you'd really have to ask them. But there IS the option that some of them might be living in Canada but not be a resident. It's a legal term and as I said, 2 years living there didn't get me any closer to being considered one. The immigration process is a big pain.

Acadians come from Nova Scotia, particularly Sunbury County (now called New Brunswick). PEI has essentially no association with Acadia other than being right next to me, and Newfoundland may well have fewer French speakers per capita than BC. They're more Irish than anything.

So, yeah, no. No Acadians there, at all.

Yeah, my distate for Harper runs deep, but this one was actually not his fault, or the fault of his government. They probably didn't even see this coming til it dropped on them.

There's lots of little hiccups in the legal system like that here. It's just people are way less litigation-happy than down in the US, so they get uncovered more slowly.

I certainly looks like this is more of a media attempt to poke at the Harper government some. This techincally could happen to a hetero couple whose Canadian marriage is not recognized in their home country. I doubt that would have made the news in that case. This isn't an attack on same sex marriage in Canada. The courts will rule and if there's a need for an ammendment it will be very quietly passed through all levels without much of a fuss.

actually, aeric, the Justice Minister has already announced that the law will be ammended immediately, and that in the interim, all marriage licenses issued are being regarded as valid.
