Yeah, Break.com tends to be a huge dipshit when it comes to the approval process. They ask basically 2 questions: "Is it a video?" and "Is it non-pornographic?". They don't care who submits it, because it's just money they are paying out. They don't check sources or the codes for it.

I think that LRR and Revver could easily have a case against Break.com and sue for lost revenue and such on the grounds of lax copyrighting policies.

As for the video, it's good every time I watch it ON LRR and it's a stitch when Ash talks about corpse-humping.

Well, that means paul can add 200000 views to the video if break had 200000 views.

LRR has no recourse because they are falling under the "Fair Use". At least in the US. I don't know what Canada's Copyright laws are like but since "copyright" was established by the U.K. in 1709 I would think the laws are similar. If LRR was giving Bill Gates' his piece of the pie that LRR is "supposedly" making off of using the Microsoft their trademark and copyrighted material then they would not be in violation of copyright.

I'm running into a similar issue with a short documentary that I'm putting together concentrating on Halo and it's effect upon markets.


On another topic I liked the piece and would like to use it in my documentary. And yes of course I won't be making any money off the documentary.

Fair Use does NOT cover what they're doing.

Fair Use covers parody, commentary, research or news reporting.
They are taking our content, putting on their site, and making advertising revenue on it.

These words. I do not think they mean what you think they mean.

You could argue that LRR's use of material from Microsoft is fair use, because they incorporated them into a new work, which parodies Microsoft. You could not argue that Break's use of LRR's video is fair use, because they use the whole entity, largely unchanged.

The Whatever Thing, LRRcast, and most popular Videos list aren't updated for the page that this video is on. I was suprised to still see Startle a Chicken up in the corner.

Judging by the still-more-than-10k-hits-a-day thing, I'm guessing that the video is still in "Batten Down the Hatches" model; the short version is that the page is in a non-dynamic bandwidth-saving mode allowing it to be served faster to the ravening hordes of viewers.

After confering with my Counselor I stand corrected.
In the US it's called Fair Use in Canada it's called Fair Dealing.

LRR is within their right to air the Halo mocumentary and use Microsoft and all it's affiliates.

Quote "if Break is getting money (through advertising, etc.) or paid someone not part of LRR for the video, then LRR has a right to request that Break cease and desist the broadcasting of their video (actually they [LRR] can do this even if Break is not getting any money, etc.). And if LRR does nothing they may lose their right to enforce any copyright that they do have."

LRR doesn't just need to get them to take the video down, they need to get them to pay LRR for the lost revenue.

Sue them. I can't believe that you won't find some lawyer willing to do this on at least a contingent fee.

I seem to remember you guys asking people not to post your videos on YouTube, but this one's on and is getting linked from BBspot here.

But if you like YouTube, then I guess that's a good thing!

That is, if you think it's worth posting on YouTube, someone else has already thought the same and beat you to it, so it'd be redundant.

yep - a central tenent of copyright law states that if you don't stand up for what is yours - you lose your rights to it. Take it from someone who learned the hard way and had a book stolen out from under them a few years back.
