Google/Youtube is responsible for the lack of communication, and should be held accountable for that. Ditto for any broken form or technical issue at their end.
However - they don't get to decide whats "fair use". They are not the ones to blame there. They have to implement ContentID as it is in order to avoid being sued. It means they have "safe harbor" protection legally.
The appeals process likewise - Google doesn't decide anything. That form you fill in gets sent to Disney/BBC/Viacom/Sony/Whoever. Those groups then decide if its fair use or not. (Ive gone though this process many,many times).
As Doug proposes, there needs to be penalties for false copyright claims.
But I really doht think Google themselves could do that legally as the law stands.
And, unfortunately, as big as Google seems I dont quite think they match the legally/lobbying might of the "Big 6" media corps at the moment.

DailyMotion seems the only one even vaguely in the same ballpark since Disney killed Blip.

Yes, even the legislators are gulls and shills in this; they're just doing whatever they're persuaded to do.

Pessimistically, I'm figuring it's going to take a horrifying and devastating fundamental 'reset' to the entirety of civilisation and society to free us of this exhibit of the Law of Unintended Consequences, like a pandemic, environmental disaster or bloody uprising/revolution coming to pass and decimating the world population, which would interrupt (or even shatter) current existing societal systems and allow such change...again, no biggie...
So until then? Get used to good people getting ground up in the gears of a reprehensible system that benefits few, inconveniences the vast majority and then takes random sacrifices from time to time. vOv
