Graham and Paul could become felons in the eyes of US Law
Sorry about the shock title, but considering the bill that's been drafted up recently, it's needed. The full bill is here, but if you need a translation from legalese (and don't want it from Destructoid), here we go: making a streaming video that contains any kind of copyrighted material is considered a felony (after 10 offenses, that is), and the government wouldn't need to wait for the copyright holders to press charges to go after that person. (The last part makes sense for murderers, but this? Really?) The bill was made mainly to appease the RIAA and MPAA over people posting movies and music to YouTube, but the law is so vaguely written that it could very easily bleed over to video games. And in fact, it'd even allow the government to go after you for posting videos of your buds singing karaoke, if you made enough money off of it.
Here's the petition, if you want to speak out against it. Because really... I don't want to live in a country where Unskippable is a crime. (Not to mention I'd be liable myself... damn my hobbies.)

Presumably this doesn't override the fair use provisions of american copyright law.

Does "Fair Use" work in Criminal Law cases? For Civil Law, that makes sense. But since it'd move it to criminal law (at least if this editorial on shoryuken), I'm not too sure. Either way, they can still slap cuffs on them while they await trial.

Oh they are trying hard to remove that, I guarantee it. I really don't like the bill at all, because it's just more proof of old media being greedy around the thought of new media.
But at the same time, The Escapist does have many contacts (I assume) with developers so they can get the proper rights to do it, so it wouldn't be copyright infringement.

This law just can't operate in the US, or the world at large, for that matter, it's basically meaningless bullshit. Between fair use, protection of parody, and general protection of free speech, it's only a matter of time before this insanely inept law falls.

As mentioned, it would affect the folks at The Escapist, but it may also make travel to the US (including PAX, PAX East and the Child's Play charity dinner) problematic.

Well if this bill forced the Escapist to stop airing Unskippable and G&P took it elsewhere, even then I doubt it would effect them much while traveling in the US. It might effect their ability to get a visa (though even that's doubtful), but not their ability to take day trips across the border any more than my drinking under the age of 21 would.
